Historic $800,000 Settlement Reached in Unincorporated Santa Clara County Habitability Lawsuit

SAN JOSE, CA, UNITED STATES, October 29, 2026 /EINPresswire.com/ -- A landmark $800,000 settlement has been reached in a severe residential habitability and constructive eviction lawsuit in unincorporated Santa Clara County, representing one of the highest single-unit habitability settlements in the county's history.

The legal action arose from severe, uncorrected habitability violations at a single-family residential rental property in unincorporated Santa Clara County. According to court filings, the tenants experienced widespread structural and environmental defects shortly after moving in, including broken heating facilities and active rodent infestations.

The situation escalated on April 5, 2022, when power provider PG&E disconnected electrical service to the property due to unpermitted and improper electrical wiring connected around the utility meter. The sudden utility shut-off left the tenants without refrigeration, hot water, lighting, or heating.

An official inspection conducted on May 31, 2022, by the County of Santa Clara Department of Planning and Development confirmed hazardous living conditions. County inspectors documented a complete lack of a required electrical system, lack of connection to a potable water supply, improper discharge of sewage, unmaintained heating, hazardous extension cord usage, and severe insect or rodent infestations. Consequently, county authorities declared the dwelling an unsafe structure unfit for human occupancy and issued a Notice of Violation requiring the building to be legalized or demolished.

Despite statutory obligations under the Santa Clara County Relocation Statute requiring landlords to provide substitute housing or four months' rent plus a security deposit refund when a property is red-tagged, the property owners failed to provide the required relocation assistance. As a result, the tenants were constructively evicted and forced into homelessness, living out of their vehicle between June to October 2022. Compounding the hardship, one of the tenants was forced to endure these conditions and subsequent homelessness while undergoing cancer treatment.

“This historic $800,000 settlement sends an unmistakable message to property owners throughout Santa Clara County that neglecting fundamental habitability standards carries severe financial consequences,” said attorney Broderick H. Brown. “No tenant should ever be forced into homelessness or subjected to life-threatening living conditions while recovering from major illness. We hope this outcome sets a critical benchmark for housing accountability, enforcing tenant protections, and deterring landlord misconduct across Santa Clara County and the rest of the Bay Area.”

The historic $800,000 settlement highlights the strict legal protections enforced in California regarding tenant habitability and illegal utility shut offs.
